Contractor Problems in South Dakota: Complaints and Your Options

Short answerIf a contractor job goes wrong in South Dakota, here is what we could confirm on official pages: where to file a complaint, contract and cancellation rules, liens on your home. Each item links to its source. Keep your contract, payments and photos.

Where to file a complaint

The division says to try to resolve the problem with the contractor first, and to follow phone calls with a certified letter, return receipt requested. For help, call the Division of Consumer Protection at 1-800-300-1986. Source

Contract and cancellation rules

If you sign at home or anywhere other than the seller's permanent business location, the contract should state your right to cancel within three business days. The division also says to confirm the contract lists the contractor's name, address, phone and license number if required, estimated start and completion dates, and who gets permits. Source

Liens on your home

The division says to ask for lien waivers with each payment, and to hold the final payment and any affidavit of final release until you're satisfied and know subcontractors and suppliers have been paid. It does not state notice deadlines. Source
